How are Damages Calculated?
In the medical practice civil lawsuit, damages may be recovered by either the victim themselves or the families or surviving next-of-kin of the victim in the event of wrongful death. Damages are divided between economic and non-economic damages. Non-economic damages are such damages as pain and suffering, mental anguish, loss of companionship, and other similar types of damages. Economic damages include such things as medical expenses, costs of therapy and home health care, lost wages, loss of earning capacity, funeral and burial expenses, and other similar types of actual economic costs. If you have experienced damages as a result of medical malpractice, whether economic or non-economic, you may be entitled to such damages.
